TERMS AND CONDITIONS: SCOTLAND 2015
Thanks for choosing to join us for a wonderful writing retreat and adventure in Scotland. These are the terms and conditions for our trip.
Payments: A non-refundable deposit of $500.00 per person is required at the time of booking. A second payment of $1000.00 is due on March 15th. The final payment will be due by May 1st.
Price includes: Shared accommodations and all meals at Newbold House, tours, all entrance fees when with the group, ground transportation with the group. Airfare and transportation to and from the airport, tips, optional taxis, meals and drinks out, and costs for optional activities are not included. Prices subject to change without notice, according to the fluctuations of the pound. If you opt for a single or double room (these are extremely limited), you’ll pay an additional cost of $1000 for the single room or $500 for one of the four double spots. These will be given on a first come basis.
Cancellations and Refund Policy: Cancellations and Refund Policy: A fee of $500.00 will be collected for cancellations up to March 15th. Cancellations between March 15th and May 15th will be for half the total amount paid. No refunds will be made during the final month before the trip, after May 15th. There will be no refunds for leaving the retreat early or arriving late. Further, there are no refunds for any part of the program that you choose to opt out of. Although we do our best to avoid this, it may occasionally become necessary for The Writer’s Journey to cancel a retreat due to insufficient registration or any other cause. If a trip is canceled due to low enrollment, you will be notified at least 60 days in advance, and your entire payment will be refunded to you within fourteen days after the cancellation. Refund of payments made constitutes full settlement, and releases Laura Davis and The Writer’s Journey from any further liability. In the rare event that the Writer’s Journey must cancel a trip, Laura Davis and The Writer’s Journey are not responsible for any additional expenses incurred, such as non-refundable airline tickets or passport fees. If the retreat is cancelled due to a natural disaster, strike, or other event outside our control, we cannot guarantee the 60 days’ notice, but you will receive a full refund of all payments made. Trip cancellation and medical evacuation insurance are highly recommended. Information about insurance will be sent to you with your confirmation materials.
Itinerary: We have the right to make partial changes to the stated itinerary. We will do our best to keep changes to a minimum.
Photo Release: We will photograph group members and group activities for use in future promotions of this trip. Please notify us if we are not free to use photographs of you.
Organizer-Participant Contract: The Writer’s Journey, Laura Davis, Newbold House, Marie Hanson, and other cooperating agencies (referred to as The Writer’s Journey) act only in the capacity of agent for the participation in all matters relating to transportation and/ or all other related travel services and assume no responsibility howsoever caused for injury, loss or damage, to person or property in connection with any service, including but not limited to that resulting directly from: acts of God, detention, annoyance, delays and expenses arising from quarantine, medical emergencies and evacuation, strikes, thefts, pilferage, force majeure, failure of any means of conveyance to arrive or depart as scheduled, civil disturbances, government restrictions or regulation, discrepancies or change in transit over which it has no control. Reasonable change in itinerary may be made where deemed advisable for the comfort and well-being of the participants. And the organizer will provide equivalent experiences in all such cases. On advancement of deposit the depositor agrees to be bound by the above recited terms and conditions. Prices subject to change without notice, due to currency fluctuations and/ or other causes.
Cancellation Fees and Penalties are defined in the pre-tour information. No partial refund or credits will be given for unused services. The organizer reserves the right to accept, retain, or cancel any prospective or actual member of the tour at any time, at any place, and for any reason, at our discretion. If any participant is removed from the tour, a proportionate refund will be made. Organizer will not reimburse participants for any substitute arrangements they make on their own. Deviations from the pre-paid itinerary are at the participants’ expense.
Payments: Trip cost is based on a minimum number of ten participants. If the minimum number is not met, The Writer’s Journey reserves the right to cancel the trip or to apply a surcharge to costs. In the case of a trip cancellation, you will receive a full refund. The Writer’s Journey is not responsible for any additional expenses incurred such as nonrefundable airline tickets or passport fees.
Release and Assumption of Risk: I am aware that during the trip that I am participating in under the arrangements of The Writer’s Journey and their agents or associates, certain risks and dangers may occur, including, but not limited to the hazards of hiking, accident or illness, forces of nature and travel by air, automobile, bus, train or other conveyance. I consent to and agree not to hold The Writer’s Journey responsible should any of their suppliers fail to provide the travel services I have purchased. In consideration of, and as part payment for, the right to participate in such trip or other activities and the services and food arranged for me by The Writer’s Journey and their agents or associates, I have and do hereby assume all of the above risks and will hold them harmless from any and all liability, action, causes of action, debts, claims, and demands of every kind and nature whatsoever, which I now have or which may arise in connection with my trip or participation in any kind of activities arranged for me by The Writer’s Journey and their agents or associates. The terms hereof shall serve as a release and assumption of risk from my heirs, executors, and administrators and for all members of my family, including minors accompanying me. I have read and agree to these conditions, especially noting the policy on cancellation and refunds on this sheet. I am aware that should I choose not to purchase insurance coverage as put forth under “Insurance:” above, I will be liable for all costs in the case of cancellation, trip delays, damage or loss of baggage and medical emergencies whatsoever. Any controversy or claim arising out of or relating to this Agreement, or the making, performance or interpretation thereof, shall be settled by binding arbitration in Santa Cruz California, in accordance with the rules of the American Arbitration Association then existing, and judgment on the arbitration award may be entered in any court having jurisdiction over the subject matter of the controversy.
